Agreement

We will only accept an order from you when you have paid a 50% deposit. Any overseas Shipping costs to be paid before dispatch, Balance payable on dispatch for overseas orders and on delivery for UK orders. All goods remain our property until paid in full.

Delivery charges to be confirmed when an order is placed.

We will normally try to make your bed in 6 - 8 Weeks (subject to amount of orders pending as all beds are handbuilt to order).  Please contact us if you require more details. All orders will be processed as quickly as possible although we will not rush through orders and sacrifice quality and are processed in the order that deposits are received.

Returns & Cancellations

Yes, we want you to be delighted with your purchase. Once you receive your bed you have fourteen days to decide if you wish to return it.

If the reason given is valid we will collect the bed and give a refund equal to the value of the returned goods minus the collection charges.

All we ask is that the goods are made available for collection in the same condition as they were when they were delivered.

If an Order is Cancelled by the Buyer prior to work being commenced by Bluewell Theme Beds then a refund of any money received will be made although we would need to cover any costs incurred by us to take the order. Once work has commenced on the bed no refund can be made.

All goods supplied by Bluewell Theme Beds come with a structural warranty of 12 months.

Any information found on our website is intended for guidance purposes only. The website, price and availability of information is subject at our discretion to change without notice to you. Any such changes will apply to subsequent orders by you. However we provide a service to you as well as links to other websites on an "as is" basis. We make no representations or warranties of any kind (except when we are dealing with you as a consumer as defined in Section 12 of the Unfair Contract Terms Act 1977), express or implied, with respect to our website or the information, content, materials or products included in our site including without limitation, warranties of merchantability and fitness for a particular purpose. In addition, we do not represent or warrant that the information accessible via this website is accurate, up to date, uninterrupted or error free.

You hereby expressly warrant that you are satisfied as to the suitability of the goods for your own specific purposes and that they are not sold to you on a trial basis. We do not guarantee that this website will be compatible with all hardware and software which may be used by visitors to our site. In no event shall we be liable for any special, incidental or consequential damages, or for interrupted communications, lost data, loss of profits, reverses or viruses which may affect your computer equipment, software, data or other property as a result of you accessing, using or browsing our website or you downloading any of the materials, data, text or images contained thereon. Our maximum aggregate liability under this agreement whether arising from negligence, breach of contract or otherwise shall be limited in respect of one incident or a series of two or more related incidents to the amount equal to the cover provided to us under our policies of insurance or the price paid by you for the goods whichever is the lesser.

Indemnity

You acknowledge that you are solely responsible for the use to which you put our service and all information and data that you obtain from our website and all warranties, conditions, undertakings, representations and terms whether express or implied, statutory or otherwise are hereby excluded to the fullest extent permitted by law. Except in respect of liability for death or personal injury arising out of negligence, we hereby disclaim and exclude to the fullest extent permitted by law all liability for any loss or damage whatsoever and howsoever arising including consequential, special, incidental or any other indirect loss or damage. Our liability to you in all circumstances shall not exceed the price which you paid for the goods.

Force Majeure

We will be released from our obligations under any agreement with you and we will not be under any liability whatsoever to you in the event that we are prevented or delayed from performing this agreement, (i.e. supplying or making delivery of any goods to you) in the event of national emergency or prohibitive Governmental regulation or by any reason or cause beyond our reasonable control.

GOVERNING LAW

This website is controlled and operated by Bluewell Theme Beds from its office in Kent, U.K. Those who choose to access this website do so at their own risk and on their own initiative and are responsible for compliance with applicable local laws. These terms shall be governed by and construed in accordance with English law. Any dispute under these terms shall be subject to the exclusive jurisdiction of the English Courts and, by using this website, you hereby submit to the non-exclusive jurisdiction of such Courts for such purposes and waive any and all objections to jurisdiction or venue in such Courts.
